Welcome to Giftable, the app that enables you to scan, import, update, and log your existing gift cards, as well as gift them to others through phone number or their gifting handle in our system. By using Giftable, you agree to the following terms of use. Please read them carefully.

1. Acceptance of Terms

By accessing or using the Giftable app, you agree to be bound by these terms of use and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use the app.

2. Description of Service

Giftable allows users to:

• Scan and import their existing gift cards.
• Update and check gift card balances.
• Log and track spending on gift cards.
• Gift gift cards to others using their phone number or their Giftable gifting handle.

3. Account Registration

To use certain features of the app, you may be required to create an account. You agree to provide accurate and complete information during the registration process and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Prohibited App Usage and Account Suspension

4.1 App Misuse

The following actions constitute app misuse and may result in immediate account suspension or termination:

• Entering intentionally incorrect or fraudulent card information
• Scanning barcodes or items that are not valid gift cards
• Manipulating the balance update feature by entering inaccurate amounts
• Any other attempts to circumvent the app's intended functionality

4.2 Payment Instrument Violations

Any suspected misuse, fraud, or unauthorized use of payment instruments will result in immediate account termination and may be reported to relevant authorities.

4.3 Enforcement

We reserve the right to:

• Monitor account activity for potential misuse
• Suspend or terminate accounts without prior notice
• Retain transaction records for investigation purposes
• Cooperate with law enforcement when necessary

5. Gift Cards and Purchases

5.1 Final Sale Policy

All gift card sales through Giftable are final. No refunds or exchanges will be processed for any reason.

5.2 Gifting Responsibility

When gifting a gift card through Giftable, it is your responsibility to ensure the accuracy of the recipient's phone number or Giftable gifting handle. Giftable is not responsible for any errors made during the gifting process.

6. Balance Updates and Logging

Giftable provides tools for updating and checking the balances of your imported gift cards. While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy of balance information. You should verify balances directly with the gift card issuer.

7. Termination

We may terminate or suspend your account and access to the app at our sole discretion, without prior notice or liability, for any reason, including if you breach these terms.

8. Limitation of Liability

To the fullest extent permitted by law, Giftable, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the app.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the app.

9. Changes to Terms

We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting the updated terms on the app. Your continued use of the app following the posting of revised terms means that you accept and agree to the changes.

10. Governing Law

These terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
